Overtime Policy Descriptions

When setting up a team member with a non-exempt status in Workyard, you'll be asked to select an overtime policy. The policy you select will automatically apply the overtime rules to any time card submitted by that team member. Below are the overtime policies available for selection in Workyard.

California Overtime Rules:

  • One and one-half times the employee's regular pay rate for all hours worked more than 8 hours up to and including 12 hours in any workday, and for the first 8 hours worked on the seventh consecutive day of work in a workweek, and any hours worked more than 40 regular hours within the workweek

  • Double the employee's regular pay rate for all hours worked more than 12 hours in any workday and for all hours worked more than 8 on the seventh consecutive day of work in a workweek.

California 4/10 Schedule Overtime Rules:

  • Any time worked over 10 hours per day on a regular workday or 40 hours within the workweek is counted as overtime.

  • Any time worked more than 12 hours per day on regular workdays and for any hours over 8 hours on those days worked beyond the regularly scheduled number of workdays established by the agreement is counted as double time.

  • The fifth day will be considered overtime; anything more than 12 hours will go towards double time.

Federal Overtime Rules:

  • Any time worked more than 40 hours per workweek is counted as overtime.

Colorado Overtime Rules:

  • Any time worked more than 12 hours per day or 40 hours per workweek is counted as overtime.

Alaska Overtime Rules:

  • Any time worked more than 8 hours per day or 40 hours per workweek is counted as overtime.

Nevada Overtime Rules:

  • If an employee earns less than one and one-half times the minimum wage rate, they must receive one and one-half times their wages whenever they work more than 40 hours in any scheduled week or more than 8 hours in any workday, unless by mutual agreement the employee works a scheduled 10 hours per day for 4 calendar days within any scheduled workweek.

  • If an employee earns at least one and one-half times the minimum wage rate, they must receive one and one-half times their wages whenever they work more than 40 hours in any scheduled week, but not for working over 8 hours in a day.

Minnesota Overtime Rules:

  • All time worked more than 48 per workweek is counted as overtime.

Standard 8/40 Overtime Rules:

  • Any time worked more than 8 hours and up to and including 12 hours per day and for the first 8 hours worked on the seventh consecutive day of work in the workweek is counted as overtime.

  • Any time worked more than 12 hours in one day and over 8 hours on the seventh consecutive day of work in the workweek is counted as double time.
